All registered users of the Alabama Appellate Courts' E-Filing System ("ACES") certify:

1. That I have reviewed and will abide by Rule 57, Ala. R. App. P., governing e-filing through ACES.
2. That I will abide by all e-filing rules, procedures, and policies adopted by the Alabama Appellate Courts.
3. That I have reviewed and familiarized myself with the e-filing procedures in the ACES E-Filing Manual.
4. That I will immediately notify the Alabama Appellate Courts IT Help Desk upon the reasonable belief that my registration information may be compromised.
5. That I am solely responsible for redaction required by Rules 52, 55, and 56, Ala. R. App. P., and any other applicable laws and that I am solely responsible for—and will indemnify and defend the State of Alabama, its entities, its employees, and its contractors (collectively "the State") who may be subject to—any liability that may arise from causing such confidential information to become a matter of public record.
6. That I will not cause any document to be e-filed for any primary purpose that would conflict with the Alabama Rules of Professional Conduct and that I may be subject to a referral to the Alabama State Bar for disciplinary consideration for e-filings that violates this condition.
7. That I will ensure that e-filings have been scanned for viruses and are virus free.
8. That I understand that the State expressly disclaims any warranty regarding, and will not be held liable under any theory arising from, the use of ACES and that any dispute will be heard only before the Alabama Board of Adjustment and only under Alabama law.
9. That I have reviewed and will abide by the nCourt Terms and Conditions when using nCourt to process payments.
10. That I understand that the Alabama Appellate Courts have the sole discretion to both modify these Terms and Conditions and to limit or terminate access to ACES at any time and without notice.
